Timeline – Agreement of Services

Service Start Date /  TIMELINE

Service will begin 3 days from the date we receive the Vision information sheet  During this 3 day time we are setting up content, adding your content into our system, setting all of your channels up in our calendar, assigning your visionary expert and testing all usernames and passwords.

For existing seasoned social media clients with all channels  set up and active you will see all of your services roll out in their entirety with no delay.

For new clients with brand new platforms being created you will see only your scheduled posts going out daily while we design your new channels. New clients who have channels all complete with design and Bios it may go faster. 

All client accounts rollout, but depending on your audience your services can rollout slower or in a lower volume while we build your audience. In some instances with clients that are brand new with no following this can take up to 60 days before you see a lot of volume.  Social accounts with very low followers will go a little slower than accounts with hundreds of followers. The first 30 days on very low accounts will be spent loading organic, relevant, timely sharable content and starting to build channels, design graphics and brand your channels. If clients have their images and branding prepared for us that will  speed things up.

We provide the services  six days per week with the exception of Thanksgiving, Christmas, July 4th and New Years Day. On those days we will post a holiday image. Clients are free to post as much as they want. There will be no credit on your account for this period of non service.

NOTICE: In the event of a national disaster or terrorist attack we will cease posting for a brief time (usually a few hours) in respect. There will be no credit on your account for this period of non service.

No refunds or credits will be given at any time for any reason. Your service end date is the date you cancel your service or we mutually cancel your service. As we give the client the right to cancel, we reserve the right to cancel your service with a 5 day notice should we determine you are not a fit for our company.

We reserve a certain number of days throughout the year for emergencies as “non-service” days, without refunds on services.  On these days clients may post if they wish. If you see a lag or drop in services or posting feel free to post on your channels. These days are reserved for our company to use in case of circumstances beyond our control.

This Agreement  contains the complete terms and conditions that apply to you during your service period with Creative Web Concepts USA.  The Services are offered to you conditioned on your acceptance without modification of services.

We do not use robots, 3rd party Apps that access social media accounts, buy, sell or provide fake likes, profiles or plagiarized content.

PLEASE NOTE: Facebook, Twitter and Instagram all have strict policies with using 3rd party software that is authorized to connect with your account. Such Apps cause a reduction of visibility in your news feed and a lack of organic reach and engagement. We do not use these services. If you purchase likes, followers or connections we reserve the right to cancel your services as these ruin your organic social accounts that we work so hard to build for you.

 Monthly Service/Payment Terms

Your monthly social media campaign includes services outlined on the link above. This is a month to month service with no contractual agreement obligating the client to remain with our company for a specific period of time. 

Why do we NOT require contracts? We don’t need contracts – We earn your business and trust everyday!

All clients must have an active subscription arrangement through Pay Pal. 

We have  no termination fees only a 30 day courtesy notice of intent to discontinue as our work is produced in advance. If you fail to give us a 30 day notice we reserve the right to not refund anything or as determined on a case by case basis we may decide to give a 1/2 refund. See details below.

We  reserve the right to release clients if they are not a fit for our company and we want our clients to feel free to stop services if they are not happy.

By subscribing to this service with Pay Pal you agree to let Pay Pal charge your card  as our merchant service provider. Our company does not have your credit card information and we have no way of accessing this information. The client is in complete control and may access Pay Pal 24/7 to cancel or discontinue billing, in which case we discontinue service immediately with no credits or refunds. 

We do not give refunds for any reason whatsoever. If you cancel there are no cancellation fees and no refunds. Each subscriber is responsible to go into their Pay Pal account and cancel their subscription immediately upon giving us notice of cancellation.

If we decide to release your service we will refund 1/2 of your prepaid service if you paid within 15 days of our cancelling. 

We require a 30 day notice of cancellation since we do not have contracts. We will continue services for the 30 days then cancel your subscription.  If you cancel your Pay Pal subscription without notice within 5 days of your next due payment the payment will go through then 1/2 of the payment will be refunded and your services will stop immediately .   This is because we already have performed services and prepared social media content to be distributed and must be paid for this work.

READ BEFORE SUBSCRIBING TO THIS SERVICE: Because of our very low prices, no contracts, no cancellation fees and that it is subscriber’s responsibility to cancel their subscription we do not engage in Pay Pal disputes. You agree by subscribing that we are not responsible for any part of a dispute and no funds will be returned as a result of a dispute.

If your payment does not go through Pay Pal or is declined by Pay Pal for any reason whatsoever it is the responsibility of the client to immediately fix expired cards or card replacement so that Pay Pal’s next attempt in 72 hours goes through. Pay Pal will make a second billing attempt at that time.

You may see a rotation of a 2 post day and a 3 post day until you get up to 75 or 100 page likes or followers.

The reason for this caution is because extreme aggressive behavior of excessive following, massive tweeting, hashtagging or posting can cause account suspension or termination.  The concern is Facebook, Twitter and Google+.

We do not guarantee time of day of posts only that in a 24hour period you will have the amount of services excluding the situation above with low numbered followers.

How The Service Works

Our team of trained experts work very hard to grow all of your social channels growing likes,, followers and connections.  Organic reach is our primary focus.  Our social media management services are performed routinely 6 days per week except for LinkedIn. LinkedIn is managed 5 days per week.  All accounts are guaranteed to receive 2-5 posts per day (24 hour period) at our discretion as to which days and which time. Each client is different and this is our strategy for each client.  We also base this on how many likes or followers your channel has. A platform with 200 likes or followers cannot handle 5 posts per day as a channel that had several thousand followers.

We provide all content shareable timely, relevant, interesting and interesting. We have the latest RSS news feed delivering to us the top real estate industry news from credible sites such as: Realtor.com, Inman, Realty Times, Bloomberg, Market Watch,  newspapers, websites  etc..

In addition we create all branded graphics, videos, sound files etc.. for distribution. We rotate content. We also take your listings and create Facebook slideshows, carousel ads, canvas ads, videos and promote  your listings.

You are responsible to provide us with your listing items.

You may provide to us any other content you want us to share and we will be happy to distribute it to all of your channels.

You may also post along side of us any time you wish.

If you see a great post please feel free to click BOOST and spend an extra $10 to get more likes and engagement.

All social media accounts are monitored 24/7 by our mobile Pages Manager APP.  In the event of an emergency we respond with action. Any other correspondence will be handled via email. All contacts will be responded to within 24 hours unless it is an emergency.

YOU AGREE TO THE FOLLOWING:

You agree that you have the full authority and right to enter into this Agreement and that you are at least 18 years of age. You also agree that you will not send us content or expect us to use the services to transmit or distribute the following:

  • Unlawful, harassing, libelous, tortuous, abusive, threatening, or obscene communications of any kind.
  • Materials that infringes or violates any third party’s copyright, trademark, trade secret, privacy or other proprietary or property right, or that could constitute a criminal offense, give rise to civil liability or otherwise violate any applicable law or regulation.
  • Objectionable materials, including without limitation, content that contains blatant bigotry, racism, or hatred, or that promotes illegal activities or physical harm against anyone.
  • Spam, chain letters, junk mail or any other type of unsolicited mass e-mail to people or entities who have not agreed to be part of such mailings.​
  • Viruses or other harmful, disruptive or destructive files.
  • Content containing nudity or pornographic material of any kind.

Disclosure of Information

We will not disclose personally identifiable information about you or your private communications (i.e., content transmitted on private, non-public lists) to third parties, without your permission, unless we believe such disclosure is reasonably necessary to: (1) comply with the law or legal process; (2) protect or defend our rights or property or that of others; (3) enforce this Agreement; (4) respond to claims that the contents of any communications violate the rights of others.

Proprietary Rights

We will not sell, trade, rent, lend or give information, digital files, email addresses or any other content that you supply to us to anyone else for any purpose.

We do not claim ownership of the materials you provide to us for purposes of using our services and which were created by you or on your behalf. By transmitting such materials for distribution to your Lists, you grant us a worldwide, royalty-free, and non-exclusive license to reproduce, modify, adapt and publish such materials solely for the purposes of providing the Services to you.

Our company uses extremely secure measures to protect your digital footprint. We use state-of-the-art anti-virus and Internet security, but that cannot protect items once things have touched the web. Facebook and other platforms can have malware, malicious links etc… that can get to your accounts by followers on platforms.

RESULTS FROM OUR SERVICES: RESULTS

WE DO NOT MAKE ANY WARRANTY THAT THE SERVICES WILL MEET YOUR REQUIREMENTS, MEET ANY INCOME OR REVENUE AMOUNTS, GUARANTEE ANY AMOUNT OF SERVICE, BUSINESS OR RESULTS.

Indemnification

You agree to indemnify, defend and hold harmless Shelley Costello of Creative Web Concepts USA, its parents, subsidiaries, affiliates, officers, directors, employees, agents, and suppliers, and their respective affiliates, officers, directors, employees, and agents, from any claim, action, demand, or damage, loss of revenue, lack of revenue generated or any other claim whatsoever arising out of or related to your use of the services.  We do not make claims or warranties of results of any kind or income, only that we perform the services as outlined.
